Attorney Darren Heitner uncovered the letter sent by Vince McMahon and his attorneys to XFL Commissioner and CEO Oliver Luck. In the letter, he tries to make the case of Luck’s dismissal.

A major issue in Oliver Luck v. Vince McMahon may be XFL parent company not giving Luck an opportunity to cure alleged material breaches.

Heitner gives more details of the case in a subsequent LinkedIn blog post where he reveals.

“Luck’s Complaint against McMahon was recently unsealed and reveals that McMahon personally guaranteed Luck’s compensation. Perhaps the most important component of the wisely crafted guaranty is that McMahon waived all defenses and discharges, legal or equitable, to his obligations under the guaranty, whether or not the employment agreement is deemed valid or enforceable.”

Oliver Luck was very wise to attach a strongly worded personal guaranty to his $35 million contract with the XFL, which could put Vince McMahon on the hook for the remainder of Luck's salary and bonuses.

Luck is no armature when it comes to the legality of agreements. He earned a degree from the University of Texas School of Law. Heitner noted this interesting tidbit.

“On May 13, Luck also filed a motion for disclosure of assets, asking the court to order that McMahon must disclose assets and property in which he has an interest, as well as debts owing to him, to satisfy the requested $23.8 million prejudgment remedy.”
